This is a common misconception. MSH Associate Brittany Gregorchik explains, “In a divorce, retirement accounts, such as 401ks, are seen as marital property so they do get divided. However, only the amount that was earned during the marriage is considered marital property. The amount in a retirement account prior to the marriage date would not be considered into the division to the other party.”
