Not all dark or black-colored mold is the toxic “black mold” people often refer to, and the type of mold itself isn’t what determines a landlord’s responsibility.

According to MSH Associate Dan Burns, the real issue is whether there’s a condition affecting habitability—such as poor ventilation, a leak, or mold impacting a tenant’s health. In those cases, the landlord may have an obligation to address the underlying problem.
