According to MSH Consultation Attorney J. Bradley Allison, parenting orders are based on the best interests of the children—and a parent’s gender is not one of the factors.

“Judges may have favored mothers 50 years ago when it was common for dads to be the breadwinners and moms stayed home and raised the kids,” Brad explained. “Today, it often takes both parents working outside the home to pay the bills. Likewise, it takes both parents to raise the children.”

He said courts look at which parent is handling the daily tasks for the children, such as providing meals, taking them to school, getting them to doctor appointments, and attending parent-teacher conferences. And that could be the mother or the father.
